These terms describe how you may use Melody Gift and what to expect when ordering a personalized song at melodygift.app. Please read them alongside our Privacy Policy and Revisions & refunds page before placing an order.
1. Using the service
By placing an order, you agree to these terms for that purchase. You must be at least 18 and legally able to enter a contract, or the age of majority where you live if higher. If ordering for an organization, you must have authority to act for it. Provide accurate contact and order information and use a payment method you are authorized to use.
2. What you are ordering
Melody Gift creates a personalized digital song based on your questionnaire and the offer displayed at checkout. Your answers guide the lyrics, mood, language and musical direction. Examples and previews illustrate possible styles; they are not your finished song or a promise of an identical voice, arrangement or result. Only items expressly included in your checkout offer form part of the purchase; physical goods, live performances and source or project files are not included unless agreed separately.
3. Your story & order details
Review names, pronunciation, language, story, preferences and delivery email before payment. We retain the answers submitted for each purchase, so later edits to your browser draft do not update that order. Email us promptly with your order number if a correction is needed. We will explain what can still be changed and any effect on delivery before agreeing a revised scope.
4. Price, payment & order confirmation
The price and currency shown for your order at checkout apply to that purchase. Payment is a one-time charge through Stripe, not a subscription. Review any taxes and final total shown before authorizing payment; your bank may apply its own conversion or transaction fees. An order record or return from Stripe alone does not prove payment: we confirm it through Stripe. If you were charged but confirmation is missing, contact us with your receipt before paying again. A separate attempt to pay may create a separate order.
5. Production & digital delivery
The delivery period displayed at checkout is saved with your order and runs from confirmed payment, in calendar days of 24 hours. Later changes to the website’s delivery offer do not alter an existing order’s promise. Production and delivery are handled by our team, and the finished song is sent to your delivery email. Check your spam folder and contact us if it has not arrived by the promised date. If clarification or a change is needed, we will discuss its effect on timing with you. Download and keep a copy of delivered files; permanent hosting is not included unless expressly agreed.
6. Revisions, cancellations & refunds
We offer free revisions until you are happy with your song. Send your order number and clear feedback by email so we can agree the adjustments; tell us if you want to change the original brief rather than refine it. Contact us promptly for cancellation, duplicate charges, non-delivery or refund questions, as production may already have started. We assess the order and work completed and explain the available remedy. Personalization does not remove mandatory consumer rights, remedies for a faulty or undelivered service, or any withdrawal right that applies. Revisions & refunds7. Your content & permissions
You retain the rights you already hold in the text and materials you provide. You give us permission to use them as needed to create, deliver and revise your song and provide support. You must have permission to submit other people’s personal information, lyrics or protected materials. Do not request unlawful, hateful, threatening, defamatory or infringing content, or misleading impersonation. We may refuse such requests and discuss the order and any payment already made with you.
8. Using & sharing your song
After full payment, you may download, listen to, give as a gift and share your delivered song for personal, non-commercial use. Contact us before commercial release, advertising, resale, licensing to others or claiming exclusive rights so any additional permissions can be agreed in writing. A purchase does not by itself promise a transfer of all copyright, exclusivity or eligibility for copyright registration or platform rights-management systems. Website branding, sample songs and other site materials are not included in your song’s permission.
9. Account access & acceptable use
Ordering does not require sign-in. To view paid order history across devices, verify the same email used for the purchase. Keep your mailbox, sign-in codes and private links secure; tell us if you suspect unauthorized access. Do not attempt to access another person’s orders, bypass security, scrape private information or disrupt the service. We may restrict access reasonably necessary to stop misuse, while preserving lawful access to support and remedies for paid orders.
10. Availability, creative results & responsibility
Music involves creative interpretation, so preferences and examples cannot specify every detail of the finished result. Use our revision process for concerns about your song. We aim to keep the site available, but maintenance, network problems and third-party outages may interrupt access. We remain responsible for fulfilling paid orders and for obligations imposed by law. Nothing in these terms excludes liability or consumer protections that cannot lawfully be excluded, including liability for fraud or deliberate misconduct.
11. Changes, applicable rights & disputes
We may update these terms for future use of the service and will change the date above. The offer and terms applicable when you placed an order continue to govern that purchase unless we agree a change with you or the law requires otherwise. If a problem arises, contact us with your order number and a description so we can try to resolve it. Nothing here limits mandatory protections or your ability to use courts, authorities or dispute-resolution procedures available under applicable law. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
